Thank you for visiting Dutchyn Farms. We are delighted to offer you the opportunity to pick your own fruit on our beautiful farm. For the safety and enjoyment of all our visitors, we ask that you please read and understand the following liability disclaimer carefully.
Assumption of Risk
By participating in fruit picking and any other activities at Dutchyn Farms, you acknowledge that such activities carry inherent risks. These risks include, but are not limited to, the risk of injury from uneven ground, slips, falls, contact with farm equipment, and exposure to natural elements such as sun, insects, and varying weather conditions. You voluntarily assume all risks associated with your visit to Dutchyn Farms.
Waiver of Liability
Dutchyn Farms, its owners, employees, and affiliates will not be held liable for any injuries, accidents, or damages that may occur during your visit. By entering the farm premises, you agree to waive any and all claims against Dutchyn Farms for any injuries, damages, or losses that you may suffer, regardless of the cause.
Safety Guidelines
To ensure your safety and the safety of others, we request that all visitors adhere to the following guidelines:
- Wear appropriate footwear and clothing for outdoor activities.
- Supervise children at all times.
- Be aware of your surroundings and avoid restricted areas.
- Use farm equipment only as instructed and with permission.
- Follow all posted signs and instructions from farm staff.
Medical Assistance
In the event of an injury or medical emergency, Dutchyn Farms staff will make reasonable efforts to assist you. However, we do not provide medical care on-site. You are responsible for your own health and well-being, and we recommend that you have appropriate medical insurance coverage.
Property Damage
Visitors are responsible for any damage they cause to farm property, equipment, or crops. Please respect our farm and handle all tools and equipment with care.
Personal Belongings
Dutchyn Farms is not responsible for the loss, theft, or damage of personal belongings. Please keep your valuables secure and be mindful of your personal items during your visit.
Agreement
By entering Dutchyn Farms and participating in fruit picking and other activities, you acknowledge that you have read, understood, and agreed to this liability disclaimer. If you do not agree to these terms, we kindly ask that you refrain from visiting our farm.

Dutchyn Farms Waiver
I, the undersigned, hereby acknowledge that I am voluntarily visiting Dutchyn Farms and participating in farm-related activities. I understand that visiting a farm and engaging in such activities involves certain inherent risks, including but not limited to contact with animals, use of farm equipment, uneven terrain, and exposure to weather conditions.
I acknowledge and understand that these risks could result in injury, illness, property damage, or other unforeseen consequences. I voluntarily assume all such risks associated with my visit to Dutchyn Farms.
In consideration of being allowed to visit Dutchyn Farms and participate in farm-related activities, I hereby release and hold harmless Dutchyn Farms, its owners, employees, agents, and any associated parties from any and all claims, liabilities, or demands of any kind arising from my visit, including but not limited to personal injury, illness, property damage, or loss.
I agree to indemnify and hold harmless Dutchyn Farms, its owners, employees, agents, and any associated parties from any claims brought by third parties resulting from my actions during my visit.
In the event of an injury, I grant Dutchyn Farms permission to seek medical treatment on my behalf, and I understand that I am responsible for any associated costs.
This waiver and release are governed by the laws of Ontario, and any legal action shall be brought in the courts of Ontario.
If any part of this waiver is found to be invalid, the remaining sections shall continue to be enforceable.
